Brazil Acts to Curb Digital Exposure of Children with New ECA Digital Law

Brazil has moved to tighten safeguards for children and adolescents online with the recent sanctioning of the Estatuto da Criança e do Adolescente Digital, commonly referred to as the ECA Digital. The measure places new duties on social media platforms to remove inappropriate content without judicial orders, requires tools for parental control and introduces age verification mechanisms intended to reduce harmful exposure among younger users.

Digital exposure of children presents rising risks

Researchers and health authorities have repeatedly reported mounting evidence that the increasing use of smartphones and tablets is producing harmful effects for children and adolescents. Studies point to higher rates of anxiety disorders, deterioration in sleep patterns and the emergence of eating disorders linked to intense online engagement. A recent study, Proteção à primeira infância entre telas e mídias digitais, found that internet access among babies and preschool children in Brazil rose from 11% in 2015 to 23% in 2024.

At the same time, an informative note from the Fundação Oswaldo Cruz found that young people are increasingly hospitalised for mental health conditions while remaining among the least likely to seek help. Although that study did not directly measure digital interactions, its authors highlighted existing research that associates intensive social media use with psychological distress, with differing impacts across genders. Depression and cyberbullying are among the most commonly reported risks.

The challenge is not straightforward. Digital spaces can be pernicious, but they also provide access to information, schooling and social contact that many families rely on for safety and communication. Many parents report that practical needs push them to allow device use at progressively earlier ages.

What the ECA Digital requires and what it leaves open

The new law increases platform responsibility. Social networks will be required to take down improper material without waiting for court orders and to supply parents with tools to oversee the accounts of their children. The statute also restricts content deemed unsuitable for minors and calls for mechanisms to verify users’ ages.

Legal scholars and child advocates welcomed the step as an advance but stressed that legislation alone will not create a healthy digital environment. Questions remain about enforcement capacity, the effectiveness of age verification systems and how to prevent circumvention. Comparisons have been drawn with more drastic proposals abroad, including recent policies in Australia that seek to bar under‑16s from social media platforms, and with school bans on devices.

Balanced responses and next steps

Experts argue that a balanced approach is necessary. Policymakers must combine regulation with public education campaigns, support for mental health services, guidance for parents and robust monitoring of platform compliance. Schools can play a role by teaching digital literacy and healthy device habits, while regulators should set clear penalties for non‑compliance.

Brazil’s ECA Digital is an important step toward protecting children online, but it should be seen as the beginning of a broader effort. Effective protection will require co‑operation between government agencies, health services, educators, civil society and technology firms. Only through coordinated action can the country hope to reduce the risks of digital exposure of children while preserving the genuine benefits that online access can provide.
