India Expands Social Security for Delivery Workers

The Indian central government has published draft rules to bring online delivery workers within the scope of the nation’s social security law, a move intended to improve protections for a workforce that has expanded rapidly in recent years.

The proposed changes cover delivery personnel who transport food, groceries and other household goods for app-based platforms such as Amazon, Flipkart, Swiggy, Zomato and others. Officials say the new provisions aim to provide basic social protections to workers who are often engaged on a temporary or gig basis.

According to the draft rules, a worker who has been employed by a single online platform for at least 90 days will qualify for an expanded set of benefits under the social security law. Those benefits include medical insurance, life insurance, a pension or retirement benefit and, for women, maternity leave.

Workers who split their time between multiple platforms will also be eligible once they have completed 120 days of work in a year across those companies. The draft clarifies that work for multiple platforms within a single day will be counted day-for-day; for example, a worker engaged by three platforms in one day will be credited with three days of employment.

Indian delivery workers social security: who qualifies and how it will work

Eligibility under the draft is conditional on registration. Delivery staff must be registered on the central government’s e-Shram portal for unorganised sector workers to claim the benefits. The rules were released for comment and officials said they expect to finalise the regulations by April after consulting stakeholders, including workers themselves.

There are currently an estimated 12.7 million delivery workers across India, many of whom are engaged on short-term contracts or as independent contractors. Planning Commission body NITI Aayog has projected that the number could rise to 23.5 million by 2029-30, underscoring the scale of the workforce that the new rules could affect.

The move follows recent protests involving more than 100,000 delivery workers across 22 cities who demanded better pay and social protections. Labour advocates have long called for clearer obligations for platforms and for mechanisms to ensure that gig workers receive statutory benefits.

If implemented, the draft regulations will require online platforms to reconcile worker records and contribute to the designated social security funds or schemes as specified by the government. That will present administrative and compliance challenges for both large platforms and smaller operators, and it will require outreach to ensure that gig workers register on the e-Shram portal and understand their entitlements.

Supporters argue the scheme will reduce vulnerability among delivery workers by providing access to healthcare, life cover and a retirement income. Critics caution that the success of the policy will depend on clear enforcement rules, timely contributions by platforms and an efficient claims process.

The draft rules are a significant step in recognising gig work within India’s labour framework. As the government moves towards finalisation, attention will focus on the rules’ operational details, their fiscal impact on platforms and the speed at which workers can be integrated into the social security system.
